Requirements for a License to Marry in Texas

The following information was provided by the Lubbock County Clerk's Office

Residence / Citizenship:

There are no residence or citizenship requirements.

Age:

The legal age to marry is 18 years for males and females. A person at least 14 and under 18 can marry with the consent of a parent or legal guardian.

Proof of Age:

Anyone 18 and over may present identification that reflects their legal name and date of birth (ie: driver's license, state ID card, passport or birth certificate). If under the age of 18, a birth certificate is required and parent or legal guardian must provide identification.

Social Security Number:

Each person must provide their social security number. However, we do not require presentation of the card.

Waiting Period:

The marriage ceremony cannot take place less than 72 hours after the issuance of the marriage license unless one party is active military or the waiting period is waived by a judge who handles family law matters.

Blood Relationship:

Cousins may marry, but a blood relationship between the prospective bride and bridegroom cannot be closer than first cousins (ie: uncle-neice, half-brother-sister may not marry.)

License Fees:

The current fee for a marriage license is $36.00, payable in cash before issuance.

Some Items To Remember:

1. Both the prospective bride and bridegroom must sign the application before a marriage license can be issued. If either one is unable to appear in person call the county clerk's office to explore options available to them.

2. A marriage license is issued when both applicants have signed (underage, parental consent has been signed) and fee has been paid. After being issued, it expires in 30 days. It is good anywhere in the state of Texas.

3. If divorced, an applicant must wait 30 days from the day the divorce was granted unless waived by a judge who handles family law matters.

4. Each applicant must answer the question on the application concerning delinquent child support obligation. However, delinquent child support does not prevent the issuance of a marriage license.

5. In Texas, persons of the same sex may not be issued a marrriage license.

6. Persons authorized to conduct ceremonies are a licensed or ordained Christian minister or priest; a Jewish rabbi; a person who is an officer of a religious organization and who is authorized by the organization to conduct a marriage ceremony; and a judge.
